Thanks Goracing, I believe there is a class action to retrieve money from Nightingale Thoroughbreds after most of the owners got final demands from debt collectors. Check out Sasha and Nightingale's Record, Not a place yet. My horse spelled for 9 Months, a tidy pick up for Nightingales.

cant they just give the horses to other trainers.This was my first time having shares in horses its really turned me off it know.i would love to know if i can get some money back so i can go with a real trainer who doesnt rip off his clients.

Know exactly how you feel, I'm in the same boat. No more taking a gamble and giving an unknown a chance. Got a share with Hancox Syndications now. Hopefully this will be a different kettle of fish. It has been my lifelong dream and I wasn't going to give up on it because of Nightingales. Hopefully this will work out.

The can give the horses to other trainers, but why would you when you get $260 per 10% a month to sit the horse in your back yard and do nothing.No even try to get the horses fit to run, have a look at the Horses stats when they do finally get a run dead last.

Good luck Goracing it was my dream to own a Race Horse, but Nightingales have stopped that Dream.

For all out there having problems with Nightingale Thoroughbreds, I contacted Racing NSW they told me Quote; Nightingale Thoroughbreds was removed from the Racing NSW register of Approved Promoters in December 2010 which means from that time Nightingale Thoroughbreds was no longer permitted to offer shares in race horses but the Product Disclosure Statements for horses approved prior to this date are still valid until the horse is retired from racing.

So Sell your Horses and get out.

Well who knows - have shares in Hot Snippet was supposed to go into work in August , then September now Nightingale do not answer phones emails or any other form of communication - maybe they have moved to the Cayman Islands

racing NSW is a joke , they licence this bloke then offer absolutely no help in trying to help owners who have invested thier hard earned with this very questionable operator. I pulled out of nightingales long ago and feel sorry for anyone still involved. I wouldnt even waste an email to racing authorites as they dont seam to care.

To sell your Horse/Horses you must have 70% in agreement. Try and find out through Racing NSW who the other share holders are, then agree to sell the Horse. Nothing Nightingale can do about it. Other Horses have gone this way, BUT guess who is buying them back at a very cheap price, yes you got it Nightingales.

my guess is he wants to start a pet food company if you are prepared to buy back some of these things.

Racing NSW has today announced the Alan Nightingale has been warned off .

Warning Off - Mr Alan Nightingale
Acting under Local Rule of Racing 6 (LR 6), Racing NSW, on Friday, 28 October 2011, warned off Mr Alan Nightingale of Denman, from all racecourses under its control.
Racing NSW took the action because of Mr Nightingale’s (also operating as Nightingale Thoroughbreds) conduct regarding activities in the racing industry encompassing the failure in respect to his conduct and the operation of the business, Nightingale Thoroughbreds, including issues of non-compliance with the provisions of ASIC Class Order 02/319; allegations of outstanding debts owing to racing industry suppliers; lack of co-operation and refusal of directions from Racing NSW in its role as Lead Regulator; and complaints from owners against Nightingale Thoroughbreds in regard to alleged unprofessional behaviour and his own behaviour toward some persons or clients within the racing industry, including Racing NSW staff.
Under Australian Rule of Racing 183 a warned off person is subject to the same disabilities as a disqualified person penalised by AR182 (1),(2),(3) & (4) and 182A.
AR 182. (1) Except with the consent of the Principal Racing Authority that imposed the disqualification, and upon such conditions that they may in their discretion impose, a person disqualified by the Stewards or a Principal Racing Authority shall not during the period of that disqualification:- [amended 1.2.01]
(a) Enter upon any racecourse or training track owned, operated or controlled by a Club or any land used in connection therewith;
(b) Enter upon any training complex or training establishment of any Club or licensed person;
(c) Be employed or engaged in any capacity in any racing stable;
(d) Ride any racehorse in any race, official trial, jump-out or test; [amended 1.9.09]
(e) Enter or nominate any racehorse for any race or official trial; or [amended 1.9.09]
(f) Subscribe to any sweepstakes;
(g) Race or have trained any horse whether as owner, lessee or otherwise;
(h) Share in the winnings of any horse;
(j) Participate in any way in the preparation for racing or training of any racehorse. [para added 1.2.01]
(2) Except with the consent of the Principal Racing Authority that imposed the disqualification, no person who in the opinion of the Principal Racing Authority or the Stewards is a close associate of a disqualified person shall be permitted to train or race any horse. [subrule (2) amended 1.10.00]
(3) Unless otherwise determined by the Principal Racing Authority that imposed or adopted the penalty, the period of disqualification of any person who contravenes any of the provisions of subrule (1) of this rule, shall automatically recommence as from the most recent date of such contravention, and the person may also be subject to further penalty. [subrule added 1.12.10]
(4) The provisions of subrule (3) shall apply to any person to whom AR182 applies, regardless of when such penalty that gives rise to the application of the rule was imposed. [subrule added 1.12.10]
AR 182A. A bookmaker shall not bet by telephone or otherwise with a disqualified person.
AR 183. A person warned-off by a Principal Racing Authority shall be subject to the same disabilities as a person disqualified.

Yes skinner I agree, A lot of good people worked hard to bring this fraudster to justice. If it was not for them maybe others like us battlers would have been exposed to his scams. The dream of owning a share in a Race Horse may now be gone for some but the newer dreamers do not have to go through what we went through with Nightingale Thoroughbreds because they do not exist any more. Three Cheers

The dream may not necessarily be gone altogether as the monthly upkeep cost is similar with other syndications but the cost of the shares is certainly not going to be $1. There are still some reasonably priced shares out there with reputable syndicators like Hancox Syndications but these are snapped up very very quickly. It will take a while longer to save for these but it is possible. Don't give up!

That's the spirit goracing, there is Syndicates out there that will suit some owners but you don't have to deal with a fraudster, you will be dealing with a pro.

I'm glad I took a stand against this germ, and I feel for those owners who didn't get out earlier.

does anyone know what the process would be for us to try and recoup our lost moneys through the courts ( ie) class action against this guy. i only burnt 3k but i would hate to think this slim has walked away with any money at all.

I have taken legal action to stop the debt collectors from putting a default action on my credit record. Please do not sit on your hands with this. You MUST reply and dispute the claims. Your Horse went to another trainer with out your knowledge is good enough for a dispute. The most you can re coupe in legal action is $600.00, the most He can get off you is $600.00 plus legal cost. Now that Nightingale has been warned off He can no longer profit from racing in NSW. post this off to your legal firm, No more action will occur.

Should I pay next months fee's even though my horse has been in the paddock for a year and I recieve very little if any updates on his progress? Did anyone here see the artical in the Newcastle Herald about other owners taking action?

I did see the article. Keep an eye out for Friday's Newcsatle Herald for a story (in Geoff Wilson's column) and a contact name to discuss options.
He's a mate of mine and I have a couple of horses with him.
